What is the Digital Millennium Copyright Act (DMCA) and how do I register my agency?

In your Terms of Use, we have provided a standard clause to address potential copyright

infringement claims and the Digital Millennium Copyright Act (DMCA).

In essence, the Terms present two methods of handling copyright matters.

First, users can either, contact you via Email-in which case, our clause notes that you will "take seriously claims of copyright infringement” and “respond expeditiously to notices regarding such matters."

Second, you may elect to follow the "safe harbor" provisions of the Digital Millennium Copyright Act (DMCA), which insulates online service providers (such as travel agencies) from liability for copyright infringement if their end users engage in infringement activities.

To participate in the DMCA, you are required to jump through the following hoops:

  1. Register with the U.S. Copyright Office;

  2. Appoint a designated agent to receive DMCA notices; and

  3. Comply with other requirements of the DMCA.

If your users proceed under the DMCA, they also must follow specific notice procedures, all of which are set out in the Terms.

We recommend that you review the DMCA provisions and decide whether or not to participate in the program, which may protect you from copyright claims if your users infringe the copyrights of any third party.
